Source: Miguel Martinez Resigning

City Councilman Miguel Martinez of Washington Heights is expected to resign later today, according to a source.

Martinez, elected in 2001, has come under scrutiny of investigators for his association to a group that allegedly misused public money.

A woman at Martinez’s district office declined to comment.

UPDATE: Here’s a notice from the U.S. Attorney’s office sent to Martinez’s lawyer, dated today, saying they were looking for information from Martinez. His lawyer, B. Michael Bellinger, is currently in court and not available for comment, according to a woman answering the phone at his office.

UPDATE II: Martinez submitted a one-sentence resignation.

Also a reader more familiar with the law than I am explains that the document posted above is more telling than I realized. “A criminal information does not mean the government wants info. Its not a subpoena. An information is, in this context, a charging document used when charges are brought and typically agreed to by the defendant. This almost always means the defendant will be pleading guilty to something, and that this has been worked out well in advance.”
